We are committed to protecting the privacy of our clients, their employees and our partners. We constantly review our systems and data to ensure the best possible service to our customers. This Privacy Policy describes the privacy practices of FitPros (“we”, “us” or “our”), and how we handle personal information that we collect through the FitPros Live Platform (the “app”), comprised of a web based application and native mobile apps developed for iOS and Android.
FitPros provides virtual and onsite wellbeing programs to keep teams connected, engaged, and healthy. Our Service is designed for enterprises (for example, businesses or government organizations) and is not intended for individual consumers. Accordingly, we treat all personal information covered by this Privacy Policy, including information about any visitors to our website, as pertaining to individuals acting as organizational representatives, rather than in their personal capacity.

Personal Information We Collect
The use of information received from Health Connect will adhere to the Health Connect Permissions Policy, including the Limited Use requirements.
Information you provide to us. Personal information you may provide to us through the Service or otherwise includes:

Contact data, such as your first and last name, salutation, email address, mailing and billing address, professional title and company name, and phone number.

Communications data that we exchange with you, including when you take our surveys or contact us with questions or feedback, through the Service or otherwise.

Transactional data, such as information relating to or needed to complete your orders of the Service(s).

Registration data, such as information that may be related to an event for which you register or host with FitPros.

Individuals who choose to register for a FitPros Platform user account (mobile and/or web applications) may, at their option, share personal activity data with FitPros and other Platform users when choosing to participate in app-based activities such as challenges and other social features. Permission to access this data is requested at the time of use within the FitPros app and must be explicitly granted by the user. If at any time the user wishes to discontinue sharing of this data, they can revoke this sharing permission. Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, our communications and other online services, such as:

Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.

Data about others. Service visitors may have the opportunity to refer other contacts to us and share their contact information with us. Please do not refer someone to us or share their contact information with us unless you have someone’s permission to do so.
How We Use Your Personal Information
We may use your personal information for the following purposes or as otherwise described at the time of collection. Please note this excludes personal activity-based information, which is never shared with 3rd parties beyond the purpose of Service Delivery, as outlined below:
Service delivery. We may use your personal information to:

in the course of providing an interactive, compelling user experience for FitPros Platform customers (mobile and/or web applications), some activity data (steps, miles, etc.) may be shared with other users on leaderboards and other social features within the Platform. Visibility of these activity data is limited to users in the same workspace (i.e. the same corporate entity), and are kept expressly private from any other workspace (i.e. other FitPros’ corporate customers). Personal activity data is never used for any other purpose than to provide an engaging wellness experience for the end user. It is never sold or shared with 3rd parties.
Research and development. We may use your personal information for research and development purposes, including to analyze and improve the Service and our business. As part of these activities, we may create aggregated, de-identified or other anonymous data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.
Compliance and protection. We may use your personal information to:

comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;

protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);

How We Share Your Personal Information
We may share your personal information with the following parties and as otherwise described in this App Privacy Policy or at the time of collection.
Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed directly by our payment processors, such as QuickBooks Payments. QuickBooks Payments may use your payment data in accordance with its privacy and security policies: https://www.intuit.com/privacy/ and https://security.intuit.com/.
Third parties designated by you. We may share your personal data with third parties where you have instructed us or provided your consent to do so. For example, we may share your personal information with hosts with whom we are collaborating to offer you the service. We will share personal information that is needed for these third parties to provide and receive the services that you have requested.
Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the “compliance and protection” purposes described above.
Business transferees. Acquirers and other relevant participants in business transactions (or negotiations and due diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, FitPros (including, in connection with a bankruptcy or similar proceedings).
Other users. Your app profile and activity data may be visible to other users of the Service (including those to whom you invite and/or share your login information with).
Your Choices
You have the following choices with respect to your personal information.
Cookies. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Service may not work properly. Advertising choices. You may be able to limit use of your information for interest-based advertising by:

Declining to provide information. We need to collect personal information to provide certain services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.
Requests to delete personal information. Individuals who have registered for personal user accounts on the FitPros Platform (mobile and/or web applications) can at any time request the complete and permanent removal of their user account and any associated personal information. Upon receiving written notification to techsupport@fitpros.com all requests for account deletion will be acknowledged and executed within 5 business days. Users may also directly delete their account via the Delete User function available at https://fitpros-api-prod.fly.dev/delete_user/. This function will remove the requested user information within 48hrs from all production and backup environments.
The Service blog may contain links to websites and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not connected to us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.
Security
We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect.
We comply with all applicable laws related to the security standards we must apply to our services, including data collection, transmission and storage, to be and remain compliant with those laws when we collect, use, handle or store your Personal Information.

The data stored by FitPros is encrypted at rest and in transit. This includes using encryption algorithms and secure protocols when transmitting data over networks and storing data securely using encryption techniques

FitPros does not store user passwords

Access to FitPros' API endpoints requires the requester to be authenticated and authorized (except for some endpoints that do not give access to any sensitive data)
However, security risk is inherent in all internet and information technologies and no method of transmission over the Internet or method of electronic storage is 100% secure.
Data Retention
Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize or aggregate your Personal Information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.
International Data Transfer
We are headquartered in the United States and currently use service providers that operate in the United States.
Children
The Service is not intended for use by children under 18 years of age. If we learn that we have collected personal information through the Service from a child under 18 without the consent of the child’s parent or guardian as required by law, we will delete it. We encourage parents or guardians with concerns to contact us.
Changes to this Privacy Policy
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service. If required by law we will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via email or another manner through the Service. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Service after the effective date of any modified Privacy Policy indicates your acceptance of the modified Privacy Policy.
